The Washington Parish School Board met in regular session on the above date with the following members present: President Richard N. Thomas, Karl Bickham, Bruce Brown, Hayward Boone, Susanne Jones, Harold Smith, Holly James, Juanita Barker, and Freddie Jefferson.  Absent: None.

 

Agenda Item #1 - Call to order.

 

The meeting was called to order by President Thomas.  He welcomed news media, School Board Attorney Wayne Kuhn, and guests.

Agenda Item #4 - Consider a motion to adopt the minutes of the July 2, 2002, special board meeting.

 

It was moved by Harold Smith, seconded by Susanne Jones, that the Board adopt the minutes of the July 2, 2002, special board meeting, as submitted to each board member.  Motion carried unanimously.

 

Agenda Item #5 - Consider a motion to adopt the minutes of the July 11, 2002, regular board meeting.

 

It was moved by Hayward Boone, seconded by Susanne Jones, that the Board adopt the minutes of the July 11, 2002, regular board meeting, as submitted to each board member.  Motion carried unanimously.

 

Agenda Item #6 - Recognition of Louisiana Reading Association Award Winners (Betty Hughes).

 

Betty Hughes, 2001/2002 Washington Parish Reading Council President, recognized Juanette Thomas, teacher at Thomas Jr. High School, who was awarded 2nd Place in the state Educators as Authors' Contest, and Dorothy Young, Principal, Wesley Ray Elementary School, who was selected as the Louisiana Reading Association's Principal of the Year.

 

Agenda Item #7 - Discuss and take appropriate action regarding quotations received for purchase and installation of commercial floor tile in main hallway at Thomas Jr. High School (William Brignac).

 

William Brignac, Supervisor, reviewed the quotations received for purchase and installation of commercial floor tile in main hallway at Thomas Jr. High School, which were as follows: Kennedy's Decorating Center - $4,014.20; Carpet Wholesalers - $4,331.00; and Decorating Showroom - $5,850.75.  Upon the recommendation of William Brignac, it was moved by Freddie Jefferson, seconded by Bruce Brown, that the Board accept the low quotation in the amount of $4,014.20, submitted by Kennedy's Decorating Center, for purchase and installation of commercial floor tile in main hallway at Thomas Jr. High School.  Motion carried unanimously.

 

Agenda Item #8 - Discuss and take appropriate action regarding quotations received for purchase of seven (7) refrigerators and twelve (12) microwave ovens for the LA 4 program (William Brignac).

 

William Brignac reviewed the quotations received for purchase of seven (7) refrigerators and twelve (12) microwave ovens for the LA 4 program, which were as follows: Amerigas - $4,649.94; and Family Furniture - $4,799.05.  Upon the recommendation of William Brignac, it was moved by Susanne Jones, seconded by Harold Smith, that the Board accept the low quotation in the amount of $4,649.94, submitted by Amerigas, for purchase of seven (7) refrigerators and twelve (12) microwave ovens for the LA 4 program.  Motion carried unanimously.

 

Agenda Item #9 - Consider a motion to adopt revised Washington Parish School Board Policy File: IFBGA - Computer and Internet Acceptable Use (Jimmy Thigpen).

 

It was moved by Hayward Boone, seconded by Juanita Barker, that the Board adopt revised Washington Parish School Board Policy File: IFBGA - Computer and Internet Acceptable Use.  Motion carried unanimously.

 

Agenda Item #10 - Consider a motion to adopt revised Washington Parish School Board Policy File: GCBA - Nonprofessional Personnel Qualifications and Duties, which will exclude substitute bus operators from the requirement of a high school diploma or General Equivalency Diploma (Richard Kennedy).

 

It was moved by Harold Smith, seconded by Hayward Boone, that the Board adopt revised Washington Parish School Board Policy File: GCBA - Nonprofessional Personnel Qualifications and Duties, as follows (revision indicated in bold print): "It is the policy of the Washington Parish School Board that a high school diploma or General Equivalency Diploma be required for all non-instructional positions effective February 13, 1992, for all new employees, except substitute bus operators."  FOR: Karl Bickham, Bruce Brown, Hayward Boone, Susanne Jones, Harold Smith, Richard Thomas, Holly James, and Juanita Barker.  AGAINST: None.  ABSTENTION: Freddie Jefferson.  Motion carried.

 

Agenda Item #11 - Consider a motion to authorize Hammonds and Sills, Attorneys at Law, to include the Washington Parish School Board in the Tobacco Settlement lawsuit as plaintiff, and the Governor, the Treasurer, and the State Superintendent of Education as defendants, relative to a supplemental appropriations bill bearing Act No. 26 (Dennie Fowler).

 

It was moved by Freddie Jefferson, seconded by Juanita Barker, that the Board authorize Hammonds and Sills, Attorneys at Law, to include the Washington Parish School Board in the Tobacco Settlement lawsuit as plaintiff, and the Governor, the Treasurer, and the State Superintendent of Education as defendants, relative to a supplemental appropriations bill bearing Act No. 26.  Motion carried unanimously.  The cost to the Washington Parish School Board will be $674.00.

 

Agenda Item #12 - Consider a motion to employ a security resource officer to serve the alternative school for the period beginning August 14, 2002, and ending January 11, 2003 (Dennie Fowler).

 

Superintendent Fowler stated that the wording of the agenda item should be changed to consider entering into a contract with the Franklinton Police Department to employ a security resource officer, that person being Earl Brumfield, at the rate of $10.00 per hour, to serve the alternative school.  The Franklinton Police Department wrote a grant for resource officers for Franklinton High School, Franklinton Jr. High School, and the alternative school,  but the grant was not approved.  The greatest need right now is an officer for the alternative school.  Efforts are continuing on pursuing a grant to generate monies for security resource officers for Franklinton High School and Franklinton Jr. High School.  At present, the following schools will have resource officers: Varnado High School and Angie Jr. High School (sharing one officer), Pine School, Mt. Hermon School, and the alternative school.  The Washington Parish Sheriff's Department is providing the officers for Varnado, Angie, Pine and Mt. Hermon schools through a grant they received.  Superintendent Fowler stated that it was agreed that Earl Brumfield would be recommended as the officer  for the alternative school, since he has served as security resource officer for Franklinton Jr. High School and the alternative school for the past two (2) years, as a reserve officer with the Franklinton Police Department.

 

It was moved by Karl Bickham, seconded by Harold Smith, that the Board enter into a contract with the Franklinton Police Department to employ Earl Brumfield as security resource officer for the alternative school at a rate of $10.00 per hour, 52  hours per day, for the period beginning August 14, 2002, and ending January 10, 2003.  Motion carried unanimously.

 

Agenda Item #13 - Discuss and take appropriate action regarding student transfer requests for the 2002/2003 school year (Richard Kennedy).

It was moved by Freddie Jefferson, seconded by Harold Smith, that the Board approve the following Personnel Adjustments, as recommended by Richard Kennedy, Assistant Superintendent, and authorize Mr. Kennedy to make any other needed personnel adjustments prior to opening of school, with the Board ratifying his action at the next school board meeting.  Motion carried unanimously.

Agenda Item #15 - Superintendent's Report.

 

A.  Superintendent Fowler recognized Vol Holden, math teacher at Varnado High School, who thanked board members and Superintendent Fowler for their support of the school system.  Mr. Vol stated, "I can't think of a single thing that we need that ya'll haven't done.  The results speak for themselves.  We do have a really good school system."  He presented a certificate of appreciation to Mr. Fowler from the "Varnado Family of Schools" (Angie, Varnado Elementary School, Varnado High School and Wesley Ray Elementary School).  He indicated certificates would also be presented to Patty Alford, Sandy Morgan, Trisha Smith, Melanie Kennedy and Charlotte Fasola.

 

B.  At the request of Richard Kennedy, it was moved by Harold Smith, seconded by Juanita Barker, that the following item be added to the agenda: Consider a motion to authorize advertisement for the position of Technology Instructional Facilitator for the LINCS EETT competitive grant that was written for the Mt. Hermon and Angie schools.  Motion carried unanimously.  It was moved by Harold Smith, seconded by Juanita Barker, that the Board authorize advertisement for the position of Technology Instructional Facilitator for the LINCS EETT competitive grant that was written for the Mt. Hermon and Angie schools, effective the 2002/2003 school year only.  Motion carried unanimously.  Mr. Kennedy stated this is a nine-month position at regular teacher salary and will be advertised for the next two weeks.      

 

C.  Superintendent Fowler informed the Board he had just received notification from the State Department of Education of a salary supplement to be paid to non-certificated support personnel.  He read the following statement:

 

RE: CIRCULAR 1086 - 2002/2003 SALARY SUPPLEMENT FOR NON-CERTIFICATED SUPPORT PERSONNEL

 

In the 2002 Regular Session of the Legislature, funds were appropriated for a salary supplement for non-certified support personnel in House Bill #1.  The $20 million appropriation was dedicated to a salary supplement for all non-certified, unclassified support persons who are not paid exclusively with federal funds.

 

The allocation of the funds for the salary supplement is based on the October 1, 2001, Profile of Education Personnel data submitted by each school district.  The allocation from the state for each full time employee is $514.48, with $476.37 going to the employee and the balance going to the retirement system for employers' portion retirement.  Part time employees will be paid on a pro-rata basis.

 

Non-certified support personnel employed as of May 31, 2002, will be eligible for the supplement.  We will pay the one-time supplement on October 11, 2002, in a separate check.

 

D.  At the committee meeting on August 5, 2002, the board heard a report from Bill Boone of Redistricting, L.L.C., regarding some reapportionment matters that could affect the upcoming school board member election.  Mr. Fowler reported, "We received word this afternoon from the Attorney General's Office that gave us permission to proceed with the election, so that matter is behind us."  According to Wayne Kuhn, "A new Attorney General's opinion was issued dated yesterday, and the Secretary of State was informed that they don't have the authority to stop a school board from proceeding with the election because they may question the manner in which the redistricting occurred.  Only a court could issue a judicial order changing that.  So, you're good to go the way you are now, according to that opinion."

 

E.  Superintendent Fowler asked Wayne Kuhn to address the Board regarding the construction contract for alterations between the Board and Bruce Hunt, d/b/a B & H Construction.  Mr. Kuhn stated, "As you know, this all came about very quickly.  When we discussed employing Bruce Hunt, at a previous board meeting, we had just received notice that the school board had been given the grant of about $1 million, which has now been adjusted to $942,000.00.  Bruce Hunt was already on the job doing the work.  We know you are supposed to advertise.  But, if you did that, you might as well not ask for the grant, because you'd probably be accepting bids tonight.  The directive from the State Department of Education says you have to submit your costs for reimbursement by September 3rd.  In order to do that, we had no choice.  The superintendent found the contractor, who was available to do the job.  We're doing it a little differently.  We're showing the world how we're doing it, so we're not hiding anything.  I know what the law is; I know you have to have a written contract with Mr. Hunt.  We, technically, cannot do a cost-plus contract.  He had already started the job; he's well into it and pushing to get it through in time.  We are substantially complying with statutes as best we can.  The statutes do say that you have to have a written contract.  I have put it in the form of a dollar amount; this contract is $500,000.  When I was revising the contract, that's what we projected at that time.  I put a clause in there that it can be adjusted by us, at our direction, for less work or more work, depending on what has to be done.  I also know that a contractor is to provide a performance bond of one-half of the amount of construction cost.  Mr. Hunt knows that; the business office knows that.  We knew he might have trouble getting this since he had already started the work.  He did have difficulty getting the performance bond.  Since he had already started, they didn't want to give him a performance bond.  Our business office is overseeing every expenditure on a weekly basis.  They know everything that's been done, all costs that have been incurred, the amount of labor going on, so it's being closely watched.  I've prepared lien waivers that we're going to give to Mr. Hunt to have the subcontractors sign that they've been paid in full.  They will not file any liens against the school board.  We'll record an extract of the contract.  We're going to hold back some of the money that's due him - 15% of the amount - until the lien period is over, to protect the board.  Rather than a performance bond, the best we can do is for him to furnish us a letter of credit for the amount, which is why you have a copy of an amendment in the contract.  I'll be honest with you.  That isn't what the law says, but the only people I think would object would be (1) other contractors, and we haven't heard from anyone, and (2) our auditors, when they look at the work; but I've tried to outline exactly what we're doing.  Why we're doing it, should be in our minutes.  We're not trying to favor any certain contractor; were just trying to get our money and do the best job we can in complying with law.  That's what I have here.  I think this will work.  I'll stand behind all this and tell anybody, we got our million dollars first, and then we tried to do what we could do.  We're all up front, the money is being well-spent, and we're monitoring how it's being spent.  I'm confident we are protected.  What I'd like for you to do is ratify the construction contract, as you have it here, along with the amendment to that contract, which will supercede any prior minutes involved with the wording of the contract itself."

 

It was moved by Hayward Boone, seconded by Holly James, that the following item be added to the agenda: Consider a motion to ratify the construction contract with Bruce Hunt, d/b/a B & H Construction, along with the amendment to the construction contract.  Motion carried unanimously.  It was moved by Hayward Boone, seconded by Holly James, that the Board ratify the Construction Contract for Alterations between Washington Parish School Board and Bruce Hunt, d/b/a B & H Construction, along with the Amendment to Construction Contract for Alterations between Washington  Parish School Board and Bruce Hunt, d/b/a B & H Construction.  Motion carried unanimously.  (SEE ATTACHED COPIES.)

 

F.  Referring to the mosquito problem, Superintendent Fowler asked William Brignac to report on his findings regarding purchasing a fogger to spray all parish school locations.  Mr. Brignac has received one price quotation of $3,695.00 and is waiting for another company to give him a quote.  He talked to Toye Taylor, Parish President, who informed him funds are not available to cover spraying outlying areas.  Superintendent Fowler stated the Town of Franklinton will spray the Franklinton High School football stadium before games and will also include the Franklinton schools in their scheduled spraying on Tuesday and Thursday nights.  Mr. Brignac will continue to obtain information regarding this matter and report back to the board.

 

G.  Referring to the School Renovation/Repair Grant for which the system has applied, Superintendent Fowler informed the Board that a "walk-through" will take place Monday, August 12, 2002.  He stated, "A walk-through doesn't mean you'll get the grant, but you're one step closer."
